1. Service Description

GentlePod ("the Service") provides private AI workspace pods — dedicated Linux virtual machines with built-in AI agents, operated by CIL LLC ("we", "us").

2. Account & Access

You must provide a valid email address and authenticate via Google, Microsoft, or email/password. You are responsible for keeping your credentials secure. One subscription provides one pod.

3. Pricing & Payment

GentlePod offers two plans: Studio at €149/month and Office at €349/month. All prices include an AI token budget and storage according to the plan:

Additional tokens can be purchased as top-ups. Payments are processed by Stripe. All prices are in EUR and include applicable taxes.

3a. Storage & Volume Extensions

Office pods include a dedicated 500 GB Hetzner Block Storage Volume, expandable up to 10 TB. Storage extensions are billed at €0.10/GB/month and take effect immediately. Downsizing of storage volumes is only available via support request. Studio pods use the VM's local storage (approximately 50 GB available). Storage cannot be extended on the Studio plan.

4. Cancellation

You can cancel your subscription at any time through the Stripe Customer Portal. Your pod remains active until the end of the current billing period. After cancellation, your pod enters a sleeping state for 90 days. During this period, you can reactivate by subscribing again. After 90 days, the pod and all data — including any attached storage volumes — are permanently deleted. Volume storage extension costs are billed until the end of the current billing period and are not refundable on a pro-rata basis.

5. AI Token Budget

Each month includes an AI token budget according to your plan. Tokens are consumed when using AI agents. If your budget is exhausted, AI features are paused until the next billing cycle or a top-up. A grace period of €5 overspend is allowed before AI features are paused.

6. Your Data

You own all data you create on your pod. We do not access, read, or analyze your workspace content. You can export your data at any time. AI conversations are processed by third-party AI providers (currently OpenAI) and are subject to their terms.

7. Acceptable Use

You may not use the Service for illegal activities, distributing malware, sending spam, cryptocurrency mining, or any use that violates the AI provider's acceptable use policies. We reserve the right to suspend pods that violate these terms.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance windows will be announced in advance when possible. We are not liable for data loss — please maintain your own backups using the export feature.

9. Limitation of Liability

To the maximum extent permitted by law, CIL LLC's liability is limited to the amount you paid for the Service in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Changes to Terms

We may update these terms with 30 days' notice via email. Continued use after the notice period constitutes acceptance. Material changes will be clearly communicated.

11. Governing Law

These terms are governed by the laws of the State of Florida, USA.
